we've put revenue on the table, as long as it's accompanied by significant spending cuts. and while we're going to continue that revenue on the table. it's going to be incumbent for my colleagues to show the american people that we're serious about cutting spending and solving our fiscal dilemma. >> democrats, obviously, control the white house and the senate, but they still need the republican-led house to sign off on whatever potential deal they reach and even though that's caused significant gridlock in the past, senate majority leader harry reid thinks a deal can be done by mid december, well ahead of the deadline. >> we have the cornerstone of being able to work something out. we're both going to have to give up some of the things that we to are a problem and so, it's like when we arrive at a point where we all know something has to be done.

there's no more let's do it some other time. >> right now, there's some outside pressure on congressional negotiators to raise the 18.4 cent per gallon federal gasoline tax, something that's being pushed by state highway officials and road builders across america. casinos are also pushing to get language legalizing online poker into a deal and governors hit hard by superstorm sandy or wanting more if federal aid to come to them through a potential deal. whatever agreement it made to avoid the fiscal cliff, it's going to be worth a lot of money and now is the time that groups are stepping up to see if they can get in on some of that. >> all right, everyone wants a little piece of the action and everyone wants fiscal restraint and they all wan their own-- >> hey, if you cut the other programs, the ones that don't involve me, that's better. >> what's the deal that gets done? do the middle class obviously gets extended, bush tax cuts.

$38,000 a year more than any other neighboring states, most other states in the midwest. let's do something better, get them rehabilitated and off the public dole and back into a productive life. >> clayton: i don't mind the prisoners watching "fox & friends," if you're out there hopefully you're not offended by that. tom, you do the studies and what's the response by the legislature or the government's office. >> the legislature appreciate the work being done and the expertise of the illinois policy institute, the think tank has been a tremendous help and we've done it many places. best example, perhaps, is a policy that was proposed, was the oklahoma helped to start the transparency movement for government information around the country so in many cases these recommendations have a big impact, but the principle, whether it's the fiscal cliff or the state budget, get rid of the waste first and then start thinking about possibly raising some taxes.

>> welcome back, everybody, there's controversy over whether the department of justice should snuff out new state marijuana laws in colorado and washington state, but the real question, does the federal government even have the right to intervene here? here to weigh in is professor of law, vanderbilt university, robert knnicos. >> thanks for having me, dave. >> dave: should eric holder intervene here, if so, what could they do to stop the laws from being implemented? >> well, they face a really serious challenge in both washington and colorado. as you know, historically, the states and the federal government have been on the same page when it comes to marijuana policy. in fact, the federal government has depended very heavily on the states to help enforce their mutual marijuana

bans, now that washington and colorado have changed course, they've decided to treat marijuana more like alcohol than cocaine or heroin and the federal government is going to have to try to figure out how to enforce its ban on its own. >> and we can look to an analogous case, the case of medical marijuana to kind of come up with a blueprint how the federal government might try to do that. in a number of staow the federal government might try to do that. in a number of states we've seen the department of justice go after landlords, after banks to cut off access to checking accounts for marijuana distributors, things like that, to try to cut down on the marijuana industry. >> a bit of bullying tactics. i'm curious from a law enforcement perspective, if you're a colorado state patrolman, if you're a state police officer, is it your obligation to enforce state and ignore federal, or vice

versa. >> you have no obligation to enforce federal law, you have no obligation to help the federal government enforce its marijuana ban if you're a state law enforcement officer, there's actually a series of cases from the 1990's, something called the anti-come men deering rule that the supreme court announced that can't enforce the state to pass a ban on drugs or something else or force the state to help the federal government enforce its own. if you're a state police officer and notice that someone is violating federal law you have no obligation to report that to the federal government or arrest that individual or prosecute the case. >> dave: that should be an interesting situation especially when you bring in the the d.e.a. and marijuana into those states. thank you for joining us, appreciate you coming in early. >> thanks for having me. >> dave: and making cursive writing extinct, i hope not. a handful of states are trying to keep it alive in schools, and most are letting it go the

jonathan hoenig. >> good morning. >> alisyn: why not play fiscal chick and and scare the other side to get your way. >> fright is not, americans are frightened and they don't know what's coming forward, whether you're joe six-pack with 10,000 in brokerage account or more importantly a multi-million dollar or billion dollar company who maybe wants to invest in a plant or jobs, how can you plan 30 years out when our own government can't legally plan 37 days out? that's a tremendous amount of uncertainty and what is known as a capital strike. capital just literally goes on strike and it's not productive. so, yes, i think that the government in this case is holding not only the american consumer hostage, but the economy as well. production can't continue as long as this uncertainty. >> alisyn: jonathan, they don't think that they are he' holding the american people hostage, they think they're

standing on principle so when both sides think they are he' standing on principle, how are they ever going to meet in the middle by december 31st? >> well, and the president's standing on principle and standing on the wrong principle. he's standing on the principle that the rich have to pay for entitlement state. obama believes that the rich have to pay for his entitlement spending, the result of course is more redistribution, less wealth. less production and who will he blame when the time comes if the economy is weak? he'll blame the rich of course. yes, people are standing on principles and i think they are he' standing on the wrong principles, that's government spending and control creates wealth. we know it doesn't, but yet, that seems to be the direction at least many on the left want to bring us down. >> alisyn: let's say the worst happens and let's say that the fiscal cliff, we did go over it for whatever reason both sides can't reach an agreement by january 1st aen we go over it. is there any way to undo the fiscal cliff, how long would it take to undo it? >> i think, alisyn the fiscal

cliff is contributing to uncertainty in the short-term. i think an even worse scenario long-term than going over the cliff would be continuing down this path. more spending and more redistribution, there's a time when the path needs to be fixed not just proverbial saying goes, kicking the can down the road. so, you know, i think even if we've got a resolution, which didn't suit the republicans,exa some up tick in the economy because what we're seeing now is economic lethargy, total economic stagnation because people are reluctant to commit capital and how can they again, look 30 years down the line when our own government can't look a couple of weeks. >> during the the campaign, joe biden floated something that some people thought might be the new plan, maybe he was foreshadowing something he says, and taxes need to be raised on people making a million dollars and above. and the president said 200,000 for an individual or above. do you think that could be the compromise? >> i think unfortunately that

might be the compromise, might be the compromise and the wrong answer and the insistence that the so-called rich, as you pointed out. is it 200, 250, half a million, what not. if they foot the bill for endless spending and entitlement state. that's not the solution, that will continuing us down the road doesn't lead to jobs or wealth or a strong economy for anyone. so we need a solution, i wish it was more of a capitalist solution, one that involved less redistribution of wealth and less government spending and intervention, but at this point, the investment class, i think, is holding up their hands and saying, how can we live long-term, the government can't see straight ahead its own face. >> alisyn: jonathan, we'll he see what happens when lawmakers supposedly get to work on the fiscal cliff issue. thanks for coming in and joining us. >> thanks, alisyn. >> alisyn: a boxing legend who once shared the ring with oscar de la hoya, after being

lasting impression on children and daughters and one is catherine herridge who joins us now, great to see you. >> yeah, good to see you, thanks for having me this morning. >> how do you meet larry hagman. >> i hit him in 2008 and he was introduced as mr. hagman and he said call me larry and what did you guys get. peter who at the time was just two, got a liver transplant and i said i was donor and he said, show me your scar, when he didn't get a reaction, okay, you show me your scar, i said whoa, i hardly know you and this broke the ice and he said to me just make me a promise that when peter is older he's never going to be ashamed or embarrassed by the scar, but see it as a badge of honor and i didn't appreciate how empowering this was and really liberating until we got into that opening ceremony at the transplant games and 10,000 people on cue, when he lifted up his shirt all lifted up their shirts or pulled at waist bands to show each other

their scar. it wasn't a stigma having a transplant and he made it something to be proud of and i think that's one of his great legacies, just an a human being. >> in 2008 i think we have some video of your son peter, just a great clip of him running, doing this race and the transplant games, which was fantasticment and we won't ask you to lift your shirt. >> thank you, i think that larry would agree it's a little early. >> alisyn: and what did he do for your son peter and for others? >> well, i think he gave him a real sense of a feeling very liberated by this and that having a transplant was not something to be ashamed of and that you could be fearless and after those games, peter took to flashing people with this scar because he felt so good about it. and just recently, he's six now, he's in first grade and told me that he wants to be a combination seal, cia guy, veterinarian, so take some of my work home with me, isn't it

fabulous that this kid feels this sense of fearlessness and that everything is possible. and i think part of that is from larry hagman and what he did for the whole transplant community that it wasn't something to be ashamed of, but it was something to really showcase in a lot of ways and to feel good about beating back death at that very young age. >> alisyn: so great and katherine because people may not remember the story though you did cover it on fox, you donated a piece of your own liver to your son peter. >> well, that's right. he was born with a rare form of liver disease and when he was five months old i was fortunate enough to be able to donate part of my liver to him and you can see in the pictures of him he's there about nine months old and at that time i never could imagine the day he'd walk across a hospital room, let alone be well enough to race in the transplant games and he's raced in them the last few years, and larry used to have the expression, which was he'd say, catherine we recycle

should schools save cursive writing? don't write it off as a hot topic and e-mails are pouring in. "fox & friends" hour three starts right now and we have two more hours of the show. >> boy. ♪ >> and this is he no time to be doing math unless you're a lawmaker on capitol hill and doing a lot of math. >> hopefully. >> right. >> they're putting it back to work, you think as the fiscal cliff looms that a few weeks left to go and we all predicted this was going to happen. post election, we knew it was going to cram and come together and dana perino says she's so glad she wasn't working in washington. she knew this would happen. >> the new senate's first task likely to fix itself. don't hold your breath. a long way from that. >> what's happening, lawmakers will return to capitol hill

tomorrow and get to work they say, and try to find some common ground to avert the fiscal cliff. >> clayton: peter doocy live with where they stand post turkey day. >> hey, clayton, falling off the fiscal cliff would put the u.s. economy right back in recession and drive the jobless rate up to 9.1% by the end of next year according to the congressional budget office. and that would not be good, but speaker of the house, john boehner along with mitch mcconnell represents republicans at the negotiating table, says he's open to finding the federal government more ways it take in money. >> to show our seriousness, we'll put revenue on the table as long as it's accompanied by significant spending cuts. and while we're going to continue to have revenue on the table.

for my colleagues to show the american people that we're serious about cutting spending and solving our fiscal dilemma. but, just because speaker boehner says he backs new revenue doesn't mean we should expect him to suddenly support a big tax increase for the wealthiest americans. >> president obama wants to let the bush era tax cuts expire, so, the top marginal tax rate would rise from 35% to 39.6% and that's going to be a major sticking point in the next month or so, but a month might be all it takes to make a deal because the senate majority leader harry reid seems to think that something can be done by mid december. >> we have a cornerstone of being able to work something out. we're both going to have to give up some of the things that we know are a problem and so, it's like when we alive at a point where we all know something has to be done, there's no more, let's do it

some other time. >> clayton:. >> reporter: some of the special interests stepping forward to see if they can convince congress coming their way, casinos legalizing online poker written in into a potential deal and supporters of the increase in the 18.4 cent per gallon gasoline tax and state highway and road builders, back to you in new york. >> clayton: everyone wants something, thanks, peter. >> alisyn: i've heard people say, why not hit the fiscal cliff? why not play chicken and get the other side to cave, not economists, okay, just dinner party, cocktail conversation, and jonathan koenig, deals with money all the time, says that would be the worst would be thing and people don't realize quite now frightening hitting the fiscal cliff is. and in fact, the cbo says it would thrust us into another recession. >> here is jonathan earlier on "fox & friends." take a listen. >> obama believes that the rich has to pay for his

entitlement spending and the result is of course more redistribution and less wealth, less production and when the time comes, the economy is so weak he'll blame the rich of course. i think they're standing on the wrong principles and that's that soft spending and control creates wealth and we know it doesn't and that seems to be the direction that at least many on the left want to bring us down. >> you heard what side he's on. and else's on the side of not increasing taxes. but they have to find some common ground though it's hard to see what that will be today. >> well, it's going to be a courageous time for john boehner, does he hold down? he's one guy you want want to be right now. even if he's in a deal he's going to want to have him out. >> he's he been on conference calls with every member of the republican caucus and had to lay this out for all of them and some republicans have gone out and sort of fallen in line with him and others spoken out

publicly, under no circumstances will i raise taxes, it will be interesting where they raise revenue. can they do it by lightning deductions and-- >> they do the write-offs and the deductions. >> but the president had one to raise on the wealthiest americans. >> dave: the president two years ago says we cannot raise taxes with the growth levels. >> alisyn: not that president, the election president. >> dave: my mistake, everyone. >> alisyn: it's hard to know what they will do, but this week should be telling. let's get to your headlines now, and tell you what's happening in the world and the muslim brotherhood is calling for massive protests in egypt, with morsi and the recent power grab. >> you can see there violent clashes between police and protesters have continued overnight. and the muslim brotherhood calls the demonstrations

against president morsi irresponsibility and opponents are trying to topple the regime so they can take over power. and morsi's critics say thousands of camped out in tahrir square and the latest decree. and this is an 80 foot yacht in flames off the miami coast and three people on board had no choice, but to jump off the boat into the water and they had to be rescued by the coast guard. and they tried to extinguish the fire, worth 750,000 and a million dollars. luckily, no one was hurt and no word yet on what caused that fire. >> and there was scary moments for passengers on board a plane trying to land in kentucky after the pilot had to apull up to avoid the others on the runway, and one of the passengers on board said everyone on board could see what was about to happen and they were scared and rehe leafed as the plane did not

attempt to land and the pilot was able to land safely on the second try. check this out. an accident leaves a truck driver dangling off the side of a bridge and it happened in the town of beaverton, oregon, rescuers raced to the scene and tried to rescue it, look how scary that one. they used a cherry picker to rescue the driver. the driver was not injured, but was arrested for driver under the influence. that's not a parking space, mr. driver. >> clayton: you're right he said earlier, a billboard for trying to talk other people out of drunken driving. >> dave: i've got my billboard to teachers around the country and a simple message and camera, can you zoom in and see that, that's my cursive writing and i just simply asked please keep cursive writing alive and i did sign that and yes, i write in cursive you often make fun of

me. >> twirly letters. >> alisyn: i don't make fun of you. but i do think you're very sentimental about it. why do you want cursive writing. >> clayton: i don't care, i hate cursive. >> dave: it's the written word that i want it stick around and i want letters and personal correspondence to stay around and i don't think scribbling print the way we do is a nice way of doing that. and this is a good way to communicate on paper. >> alisyn: and when you-- >> the argument is in some of schools in alabama, california, georgia and maine have added cursive requirements to their education curriculums and other states are looking to get rid of them as a waste of time. if you've got seven hours in a school day to focus on certain topics and improve and prepare us for the next generation and the next 20 years of the kid's lives. cursive to me is at the bottom of the pile. we do everything with

parenting movement that you're heading. here is another one. make meal time meaningful. how do you do that? >> again, i know parents are so busy, everybody is stressed and people don't know how they are he' going to slow their busy lives so i suggest taking something that you're already doing, perhaps having a meal together, which is wonderful family time, or making a meal together. and so, i suggest that people have fun meal time conversations and sometimes kids don't respond to how is your day and just as adults don't always respond, but i have lots of fun tips in the book, like what color was your day or what flavor ice cream was your day, things that kids might respond to and might get them to reveal something they won't reveal ordinarily. >> dave: we tried doing this at thanksgiving and my kids weren't registering and pumpkin pie. and i'm guilty of number three where my son just stopped one sport and saying how do we replace the sport in this upcoming session, do you need to say no, every once in a while. >> you do, actually, especially at holiday time.

a particularly frenzied time because we want everything to be perfect. we want the perfect home, want our kids to do every activity and want to envoy everything, and i'm saying, sometimes you have to say no, and choose one or two favorite activities, one or two sports at a time. one or two holiday activities and if you missed something, you can do it again later. sometimes the couple things will be become beloved family traditions and let go of the frenzy and have important down time. >> here is one that's hard for everybody, give electronics the day off. what are you supposed to do with the 24 hours? >> fortunately, a lot of ideas in my book for fun, low key, easy games, crafts, things that many of us forgot how to do. >> i advocate giving electronics, if not the day off. an hour and 15 minutes after dinner, go for a walk around the neighborhood, and enjoy your family and enjoy your time, and your kids want to be with you and spend time with you, if we can make the small changes and they will have a

the economy to race taxes on those who create jobs. >> president obama said that in 2010 right after the mid term beating the busheir raw tax cuts were set to expire and he extended them. a financial expert taking on the president's plan and what it may do for this country. >> it is uncertainty in the short term. a worse scenario long-term than going over the cliff would be continuing on this path more spending more redistribution. it has to be fixed. kicking the can down the road as the saying goes. i think even if we got a resolution which didn't suit the republicans for example you would probably see some up tick in the economy. what we are seeing now is economic leaththargy. how can they look 30 years down the line when our own government can't even look a couple weeks.

general way. when i met the force of nature that is larry hagman i was 17 years old. i had been raised by a single mother who was mentally ill. i had my own apartment from the time i was 15 years old and i never had a father figure. larry hagman came into my life at 17 years old and became the father figure that i longed for and he was a guiding force in my life. he taught me how to be professional. he taught me the craft of acting. he taught me how to behave on a set. he was an amazing, amazing human being. he was so protective of me because i was so young starting the show, but at the same time he expected and demanded a lot from me because he believed in me, and just so on a general personal note, he meant so much to me. >> it sounds like it. >> that's so wonderful to have a

mentor like that who takes you under his wing and cares so much about you. i was interested to read that you also said in addition to that serious role that he played as your surrogate father that he also could be a great pank st-- prankster on the set. >> oh my gosh. last time he said come here little niecey. come here. follow me. i called him uncle larry. on the set there are these sort of wooden rafters where they set up the lights up above the actual set where the action is going on. so barbara and jim had a scene at the dining room table just the two of them. larry gets me. we climb up this thing. he's got these bubble machines one that blew these great big bubbles another that blue hundreds of little bubbles. they are rehearsing and doing their seen down stairs a serious scene. we start blowing all of these bubbles that come raining down

on the set you hear barbara yell an expletive i can't say. jr, jr, knock it off. he was always, you know, he taught me to you to work really hard, but have fun doing it. one of the first things he told me when i was 17 years old, he said, you know i had a nervous breakdown doing "i dream of genie" i am going to tell you something right now it's not worth it. have fun. have fun while you are working this hard. i have. it was -- that was the greatest lesson any one could have taught me to really enjoy the process. >> that's really nice. it's interesting you bring that up. he didn't shy away from his own medical issues. we had one of our correspondents on here katherine herridge who got to know him as an organ transplant advocate. he really championed other off camera causes. >> yes, he did. he was amazing that way.

i will say this. larry has been very open about his alcoholism and his drinking. i swear to god i never saw him -- he never messed a line, he was never late a second. he was always punk actual. he had -- punwhen he had the li transplant i said uncle larry you are one of the greatest actors all of the time. how could you perform like that while you were drinking that heavily. it took a moment. it was almost reflective and he said, think of what i could have done if i wasn't drinking. it was one of those things that i kind of went, wow. but he never held up production. was never late. >> that is poignant. charlene tilton it's great to see you. everyone remembers you as lucy ewing. thank you for sharing your personal remembrances of larry hagman today.

that's why they make it look as so smokers cost more in reality and anybody can look this up. use your search engine the cost of smoking in healthcare you will find even the congressional research service says it's nonsense. >> allison, this is pizbizarre. gary noland was the candidate for president of the libertarian party which stands for american free enterprise and letting businesses not government make their decisions. millions of businesses have already made the decision based upon very strong evidence that they trust that smokers cost more about 112,000 dollars per year per smoker. gary the libertarian guy wants to say, no, federal government should step in and prevent this. this is crazy. we also know most smokers say they want to quit. one of the most effective ways to help them quit to do what they already want to do is impose a financial incentive. 50 percent surcharge provide a strong financial incentive to

get them to do what they already want to do that will save us 10's of billions of dollars. it's a no brainer. >> that isn't the free market that's the federal government, obama care. >> they are not requiring it they are just permitting it. they are permitting it. >> john is that the way you -- >> go ahead gary. >> well, the point is it is not the free market. secondly if we are going to talk about people's history, remember john is the guy who wants to sue mcdonalds and burger thing because people eat too much. if you look in the 12,000 dollar figure, that's nonsense. by the way if john feels the way he does if he thinks his study is accurate it is clear what he wants to do is kill poor people. because this proportionately it's the poor people who smoke and the study that they just did by the state of new york indicates when you raise costs for the poor with regard to tobacco they spend more on tobacco. >> in other words you don't think the costs would be going to their medical care they would

just buy more cigarettes. >> actually the studies show that imposing additional costs is the most effective way to get people to quit smoking. it works for poor people, it works for young people. under obama care whether we like it or not everybody is going to have health insurance so they will be covered and this idea that it is killing people is crazy. also gary raised the regulations. the regulations do not require anybody to do anything. businesses will make their own individual decisions based upon how they read the statistics and the federal government is simply saying you can do it provided it's not more than 50 percent. saying as we do with age same as we do with geographic location. it's not discrimination it's personal responsibility. >> gary we have to leave it think. you know what i concluded we booked exactly the right guests. you know a lot about each of your sides. thank you for coming in for this
